1. Introduction
These Terms & Conditions ("Agreement") govern your use of BuyBot's subscription management application and website. This Agreement is between you and BuyBot. BuyBot provides a service that connects to your merchant accounts to help you manage subscriptions and recurring payments.
2. Acceptance & Eligibility
By accessing or using our services, you agree to be bound by this Agreement. To use our services, you must be:
- A legal resident of the United States
- Of legal age in your jurisdiction
- Not prohibited by law from using the service
3. Agreement Modifications
BuyBot reserves the right to amend this Agreement at any time. Changes will be posted on our website and become effective immediately upon posting. Your continued use of the services after any modifications indicates your acceptance of the updated terms.
4. Privacy
Your privacy is important to us. Our End User Privacy Policy is incorporated into this Agreement and describes how we collect, use, and share your personal information. We reserve the right to update our privacy practices at our discretion.
5. Technology Requirements
To use our services, you need an internet-connected device capable of accessing the BuyBot platform. You are responsible for ensuring your device and internet connection meet the necessary requirements.
7. Data Usage
We will use your information to provide you with the services you request and for our own internal business purposes, including improving our services, conducting analytics, and ensuring the security of our platform.
8. Limitations of Use
You agree not to engage in any of the following prohibited activities:
- Reverse engineering or decompiling any part of the service
- Unauthorized access to our systems or networks
- Scraping or harvesting data from our services
- Disrupting or interfering with the service or servers
- Using the service for any illegal purpose
9. Intellectual Property
All BuyBot Materials, including but not limited to software, designs, text, graphics, and logos, remain the exclusive property of BuyBot. No reproduction, distribution, or use of any BuyBot Materials is permitted without prior written consent.
10. Termination
BuyBot may terminate or suspend your access to our services at any time, without prior notice or cause, in our absolute discretion. Upon termination, your right to use the services will immediately cease.
11. Warranty Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BUYBOT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DEFECTS, OR THAT ANY INFORMATION PROVIDED THROUGH THE SERVICES IS ACCURATE OR RELIABLE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUYBOT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION SHALL NOT EXCEED USD $200. IN NO EVENT SHALL BUYBOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
13. Indemnification
You agree to indemnify, defend, and hold harmless BuyBot and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your access to or use of the services, your violation of this Agreement, or any dispute with a third party.
14. Dispute Resolution & Arbitration
Any disputes arising from this Agreement shall be resolved through binding arbitration administered by the American Arbitration Association. Class actions and class arbitrations are prohibited. You may opt out of arbitration within 60 days of accepting this Agreement by emailing support@buybot.app.
15. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Section 14 (Dispute Resolution & Arbitration) is governed by the Federal Arbitration Act.
16. Severability & Waiver
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The failure of BuyBot to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
